Philippa Foot’s Doctrine of Double Effect and the ‘Trolley Problem’: ‘Moral Dilemmas’ and the Agent’s Decision-Making Problem in Applied Ethics
Abstract
This study focuses on Philippa Foot’s analyses of the problems and criticisms of the “double effect doctrine” and her proposal for a new version based on her own interpretation. Foot states that the main reason for bringing the doctrine of double effect to the ethical agenda is the “abortion problem”. When a pregnant mother’s life or the life of her baby is endangered, the decision, choice, or responsibility arising therefrom as to which of the two should be saved falls within the field of enquiry of the doctrine of double effect. Foot deepens the issue through many examples of moral dilemmas, especially the “trolley problem”, based on the evaluations of the doctrine of double effect on the abortion problem. There are three interpretations or versions of the double effect doctrine, two of which are existing and one of which expresses Foot's proposal, based on the evaluation of dilemmas and the distinction between whether the agent “intends” to act or merely “foreseen” the consequences of the action. In this study, these three interpretations are introduced and Foot’s new version is analyzed and clarified on the one hand, and on the other hand, it is criticized in terms of the other two existing versions and it is argued that this proposal is insufficient in terms of offering a solution to the doctrine of double effect due to its nature. However, the abortion problem, which Foot sees as the reason or the starting point of the double effect doctrine, is a fundamental subject of discussion in the field of bioethics. Bioethics is one of the various subfields of applied ethics. In this respect, the study, following Foot’s order, moves from the abortion problem to the doctrine of double effect, and from there, by analyzing other examples of moral dilemmas that have come to the fore within the scope of this doctrine, actually discusses a problem that is subject to bioethics in a narrow sense and applied ethics in a broad sense. In this study, it is argued that the doctrine of double effect and the examples of moral dilemmas raised in this context should be considered within the scope of applied ethics for this reason.

Philippa Foot’un Çifte Etki Doktrini ve ‘Tramvay Problemi’: Uygulamalı Etik Açısından ‘Ahlaki İkilemler’ ve Failin Karar Verme Sorunu
Abstract
Bu çalışma, Philippa Foot’un “çifte etki doktrini”ne dair ortaya koyduğu sorunlar, eleştiriler ve kendi yorumuna dayanan yeni bir versiyon önerisine dair çözümlemelere odaklanmaktadır. Foot, çifte etki doktrininin etik gündemine taşınmasının temel nedeninin “kürtaj sorunu” olduğunu söyler. Hamile bir annenin kendisi ya da bebeğinin yaşamı tehlikeye girdiğinde ikisinden hangisinin kurtarılacağına dair karar, seçim ya da bundan doğan sorumluluk “çifte etki doktrini”nin soruşturma alanına girmektedir. Foot, “çifte etki doktrini”nin “kürtaj sorunu”na yönelik değerlendirmelerini temele alarak başta “tramvay problemi” olmak üzere pek çok ahlaki ikilem örneği üzerinden meseleyi derinleştirmektedir. İkilemlerin değerlendirilmesi ve failin eyleme “niyet ettiği” mi yoksa eylemin sonucunu sadece “öngördüğü” mü ayırımına dayanan “çifte etki doktri”nin ikisi mevcut, biri Foot’un önerisini ifade eden üç yorumu ya da versiyonu söz konusudur. Çalışmada bu üç yorum tanıtılmakta ve Foot’un önerisi olan yeni versiyon bir yandan irdelenip açık kılınırken öbür yandan diğer iki mevcut versiyon açısından da kritik edilmekte ve bu önerinin “çifte etki doktrini”ne doğası gereği bir çözüm önerisi sunma noktasında yetersiz kaldığı savunulmaktadır. Bununla birlikte Foot’un “çifte etki doktri”nin gündeme gelmesinin sebebi ya da başlangıç noktası olarak gördüğü “kürtaj sorunu”, biyoetik alanın temel bir tartışma konusudur. Biyoetik ise uygulamalı etik disiplinin çeşitli alt araştırma alanlarından biridir. Bu doğrultuda çalışma, Foot’un izlediği sırayı gözeterek, kürtaj meselesinden “çifte etki doktrini”ne geçerek, oradan da bu doktrin kapsamında gündeme gelen diğer ahlaki ikilem örneklerini inceleyerek aslında dar anlamda biyoetiğe, geniş anlamda ise uygulamalı etiğe konu olan bir meseleyi tartışma konusu yapmaktadır. Çalışmada “çifte etki doktrini”nin ve bu kapsamda gündeme gelen ahlaki ikilem örneklerinin, bu gerekçeyle, uygulamalı etik alanının kapsamı içerisinde değerlendirilmesi gerektiği savunulmaktadır.
